2. Definitions

• "Client" or "You" means any person or entity using our services
• "Photographs" includes physical prints, negatives, and digital images submitted for restoration
• "We," "Us," or "Our" refers to Vintage Touch
• "Website" means our website located at this domain

3. Service Terms

3.1 Eligibility

• You must be at least 18 years old to engage our services
• You must have legal authority to submit photographs for restoration
• You represent that you own or have permission to restore the photographs submitted

3.2 Service Agreement

• Services begin upon acceptance of your request and payment processing
• We reserve the right to decline service requests at our discretion
• Service specifications and timelines are provided as estimates
• Actual results may vary based on photograph condition and complexity

3.3 Client Responsibilities

• Provide accurate information about photograph history and desired outcomes
• Ensure photographs are legally yours to restore and reproduce
• Respond to communications regarding project decisions in reasonable timeframes
• Accept delivery of completed work within agreed timeframes

4. Photograph Handling

4.1 Care and Security

• We handle all photographs with professional care following conservation guidelines
• Physical photographs are stored in secure, climate-controlled facilities
• We maintain insurance coverage for photographs in our care
• Despite our precautions, we cannot guarantee against all forms of loss or damage

4.2 Limitation of Liability for Physical Items

While we exercise appropriate care, our liability for physical photographs is limited to:

• Replacement value not exceeding SGD 500 per photograph unless higher value is declared and insured
• No liability for sentimental or emotional value
• No liability for damage resulting from pre-existing condition not disclosed

4.3 Return of Photographs

• Physical photographs are returned via secure shipping methods
• Clients are responsible for arranging pickup if preferred
• Photographs not collected within 90 days may incur storage fees
• After 180 days, uncollected photographs may be disposed of with notice

5. Intellectual Property

5.1 Ownership of Original Photographs

• You retain all rights to your original photographs
• You are responsible for ensuring you have rights to submitted photographs
• We assume no responsibility for copyright infringement by clients

5.2 Restoration Work

• Restored digital files are provided for your personal use
• You may print, share, and reproduce restored photographs for personal purposes
• Commercial use of restored photographs requires separate agreement
• We retain the right to use restoration techniques and methods developed

5.3 Portfolio Use

• Photographs are not used for marketing without your explicit written consent
• If permission is granted, only before-after comparisons may be shown
• You may withdraw permission for portfolio use at any time

6. Payment Terms

6.1 Pricing

• All prices are in Singapore Dollars (SGD) and include GST where applicable
• Pricing is as quoted at time of service agreement
• Additional work beyond original scope may incur additional charges
• We will notify you of additional costs before proceeding with extra work

6.2 Payment

• Payment is required before work begins unless otherwise arranged
• Accepted payment methods are specified during booking process
• Completed work is released upon payment confirmation
• Late payments may incur additional fees

6.3 Refunds and Cancellations

• Cancellations before work begins receive full refund minus processing fees
• Cancellations after work has started are subject to charges for work completed
• Refunds for unsatisfactory work are considered on case-by-case basis
• Refund requests must be made within 14 days of delivery

7. Service Limitations and Disclaimers

7.1 No Guarantees

• Services are provided on an "as is" basis without specific outcome warranties
• Restoration results depend on original photograph condition
• We cannot guarantee recovery of all damaged or faded details
• Realistic expectations are set during initial consultation

7.2 Technical Limitations

• Some damage may be irreversible or beyond current restoration capabilities
• Reconstructed areas represent informed interpretation based on available information
• Color accuracy in restoration work is approximate due to age and fading

7.3 Limitation of Liability

To the maximum extent permitted by law:

• Our total liability is limited to the amount paid for the specific service
• We are not liable for indirect, consequential, or emotional damages
• We are not liable for damages from third-party services or equipment failures
• These limitations do not affect rights that cannot be excluded under Singapore law

8. Prohibited Uses

You may not:

• Submit photographs you do not own or have permission to restore
• Use our services for any illegal or fraudulent purposes
• Attempt to access systems or data not intended for you
• Interfere with or disrupt our services or website
• Submit inappropriate, offensive, or harmful content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others

9. Dispute Resolution

9.1 Informal Resolution

Before pursuing formal action, we encourage clients to contact us directly to resolve concerns. Most issues can be addressed through open communication.

9.2 Mediation

If informal resolution is unsuccessful, both parties agree to attempt mediation before litigation.

9.3 Governing Law

• These terms are governed by the laws of Singapore
• Any legal proceedings will be conducted in Singapore courts
• Singapore law applies regardless of where you access our services

10. Service Modifications

• We reserve the right to modify, suspend, or discontinue services with reasonable notice
• Active projects will be completed according to original terms
• Pricing and service offerings may change; current clients are not affected
• Website content and features may be updated without notice

11. Termination

11.1 By Client

• You may cancel services according to our cancellation policy
• Refunds are processed according to Section 6.3

11.2 By Vintage Touch

• We may terminate services for violation of these terms
• We may decline to continue services with reasonable notice and refund
• Termination does not affect rights and obligations that arose before termination

12. Changes to Terms

• We may update these terms periodically to reflect business or legal changes
• Updated terms will be posted with a new "Last Updated" date
• Material changes will be communicated to active clients
• Continued use of services after changes indicates acceptance
• Existing service agreements are governed by terms in effect at time of agreement

13. General Provisions

13.1 Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and Vintage Touch regarding our services.

13.2 Severability

If any provision is found invalid or unenforceable, remaining provisions continue in full effect.

13.3 No Waiver

Failure to enforce any right or provision does not constitute waiver of that right or provision.

13.4 Assignment

You may not assign or transfer these terms without our written consent. We may assign our rights and obligations to a successor entity.
